Obolonskiy district court of Kiev continued consideration of the case of ex-President Viktor Yanukovych of treason.
Protection of Yanukovych believes that the court should return to the Prosecutor the indictment on charges of treason, ex-President of Ukraine, after which the prosecution should close this trade.
“The Prosecutor’s office must comply with the requirement of the Criminal procedure code and close the criminal proceedings after return of an indictment,” said the lawyer Vitaly Serdyuk in court on Friday.
He argued that, in particular, the fact that there was a violation of the terms and renewal of a pretrial investigation in this case and in this regard the indictment in the case of treason could not be considered by court on the merits.
In turn, the prosecutors of the Chief military Prosecutor’s office opposed this position of the lawyer and stated that the investigation was carried out with observance of all necessary procedures, and there is no grounds for return of the indictment.
The lawyer also asked the court to interrogate the preparatory session on the case of treason, a number of witnesses – employees of Administration of the state, which, according to him, can you tell us about the circumstances of the assassination attempt on Yanukovych in February 2014 and confirm the position of the defense that the former President cannot personally participate in the hearing on the territory of Ukraine because of threats to his life and the absence of guarantees of security.
In response, the presiding judge noted that the stage statements motions in the preparatory meeting has already finished and in the process the court may not consider the investigation of the assassination of Viktor Yanukovych, even if this was the place.
The court then invited the attorneys to speak about the possibility of considering the case for special (accelerated) procedure.
The lawyers reiterated that they are against this order of the proceedings for treason and make arguments in support of its position.
Also at the meeting, the defenders of the Yanukovych voiced the necessity of organizing the participation of their client in the meeting by video conference, organized under the procedure of international legal assistance.
