Journalists accused of violating privacy.
After the incident at the airport in Kyiv with participation of protection of Victor Medvedchuk in the National police and the General Prosecutor of Ukraine filed allegations of a criminal offence on the part of journalists. This was stated on Friday, 10 November, said lawyer Igor Kirilenko, representing the interests of Medvedchuk.
“The actions of the journalists of Radio Liberty in breach of current legislation and contain all the elements of a crime under article 182 of the Criminal code of Ukraine (violation of privacy). Now in connection with these developments in the National police of Ukraine and the General Prosecutor of Ukraine filed the application on the committed criminal offense,” – said Kirilenko.
The lawyer called the actions of the journalists of “provocations”, and said that they are “just in the last week took place twice – on 5 and 7 November.”
“The journalists tried to provoke the guards Medvedchuk V. V. to fight, while one of the assailants was seen the weapon. The guards acted lawfully, did not use any weapons or special means, did not use physical violence. None of the attackers has not suffered”, – said the lawyer.
Counsel refers to article 32 of the Constitution of Ukraine, according to which interference with private and family life is unacceptable. Part 2 of this article prohibits the collection, storage, use and dissemination of confidential information about a person without his consent.
“The decision of the constitutional court No. 1-9 / 2012, explaining this article of the Basic Law stipulates that confidential information about the identity is any information and / or data about relations of non-property and property character, circumstances, events, relations, etc. associated with the person and members of his family. In the same decision, the constitutional Court assumes the validity of the collection and dissemination of information concerning the only persons authorized to perform state functions or local self-government bodies, officials or authority. Mr. Medvedchuk V. V. such a person is not” – said Kirilenko.
