At first glance such an idea seems absurd, especially given the Ukrainian realities. However, actually, the answer to this question lies in the legislation of Ukraine.
So, according to the Law of Ukraine “On road traffic”, the responsibility for the maintenance of roads rests with local authorities. The authorities should provide a convenient, safe, economic and continuous conditions for the movement of vehicles and pedestrians on the sidewalks, streets and roads of the village.
According to spelled out in the legislation requirements, the roadway surface should be free of subsidence, potholes, sagging or other deformations. That is, legally, nothing should impede traffic. The only caveat – the maximum allowable norm of pits or gouges is 4 cm, and it provided the term of liquidation within 10 days.
Thus, on the basis of established norms and standards, having secured the relevant legislative framework, the drivers affected by the improper state of the roads, feel free to contact the local authorities or directly to sue in court for damages. It is important to pre-assess the level of monetary compensation. This will help the result of passed examinations that will confirm that the person is really suffered from violations of road maintenance.
