As explained by one of the initiators of the bill, the head of the parliamentary Committee Arthur Ward, the only norm of legislative acts regulating travel of children outside Ukraine, left V. 313 of the Civil code of Ukraine, which stipulates the right of individuals under the age of 16, to travel outside Ukraine only with the consent of parents (adoptive parents), guardians and their accompaniment or accompanied by persons authorized by them.
At the same time, this rule provides the child’s right to travel outside Ukraine on the basis of a court decision, multiple / out parental consent, but it is also difficult to travel outside of Ukraine, children whose parents are outside of Ukraine residing in the temporarily occupied or uncontrolled territories of Ukraine or to refuse to grant consent to leave the child, reducing the scores to each other.
“This particularly affects the children who regularly take part in international sports competitions, international competitions, Olympiads, etc., as well as children in need of treatment outside of Ukraine. The parents forced each child to present a notarized authorization or to obtain a separate court order. The bill 6647 would enable parents to give permission for one or more visits child outside Ukraine for a period up to three years, protects the right of the child to travel in the absence of consent of one of parents, besides, the courts have the right to give such permission,” said Ward.
Bill No. 6647 was registered in the Verkhovna Rada of Ukraine on 23 June 2017 and submitted for consideration by committees in the first reading.
