This happens on the basis of a list of objects of intellectual property included in the customs register on the website of the State fiscal service (GFS). While it is reported about the facts of a block of parcels with electronics some brands, but the problem can feel and traders of cars.
Thus, the registry includes many automobile brands: Chevrolet, Honda, Lexus, Mercedes Benz, Opel, Subaru, etc. Are there and brands of motor oils, tyres and other automotive products.
In accordance with applicable law, the representative of the trademark owner can allow or deny to block the send and return parcels.
Similarly with the “gray” market fought in Russia. After a series of legislative initiatives to import products automotive brands in the country could only owners of registered trademarks — that is the official importers or representatives. Or other persons with permission of the copyright holder. Initially, such innovations in Russia are not taken seriously, but after the import controls have tightened — “grey” the market of new cars in Russia actually died.
In Ukraine such legislative field there is a long time, but the import somehow didn’t work out. Authorized dealers are not rarely complained that their rights were violated. Even had a few demonstrations of precedent when punishing small HUNDRED, for the use of the logo (brand) of the car brands. But before total stop of import of goods on the basis of lack of rights to the brand! — this has not happened.
