Kolmogorov was released from custody.
The high specialized court of Kyiv granted the appeal of protection in the case of Berdyansk border guard Sergey Kolmogorov, and reversed the sentence of seaside district court of Mariupol, sending the case back for retrial.
This news caused a strong reaction among supporters of the military at the walls of the courthouse, and social networks.
Most commentators agreed that Kolmogorov was convicted unfairly, also noting the imperfection of the Ukrainian judicial system. Some also pointed to the fact that the guard spent 3 years in prison, advised him to complain to the European court of human rights.
We will remind, incident with Sergei Kolmogorov occurred on 9 September 2014. Soldiers spotted near the coast of the car that flashed their lights, giving any signals, and then headed towards the checkpoint.
On the requirement to stop for check of documents the driver stepped on the gas of the car and went on break. Despite warning shots, the machine speed only increased, after which the guards opened fire. The passenger vehicle was killed and the driver, a native of Donetsk, was not injured.
As a result, the border guard Sergey Kolmogorov was convicted of Mariupol by the court to 13 years in prison for murder and abuse of power.
