In the network appeared the main provisions of the new reform.
The Verkhovna Rada of Ukraine 22.06.2017 No. 6614 registered a draft Law of Ukraine “On amendments to some legislative acts of Ukraine on increasing the pensions”, which 13.07.2017 adopted in the first reading.
The draft Law provides for changing the terms of the pension according to the Law of Ukraine “On state service” dated 10.12.2015 No. 889 (Law 889) to the persons specified in paragraphs 10 and 12 of section XI of the Law 889.
The draft Law provides for the possibility of a transfer to a pension in accordance with the Law of Ukraine “On compulsory state pension insurance” without the application of a person who reports koda.gov.ua.
In addition, provided that if the person became entitled to a pension in accordance with the Law of Ukraine “On state service”, the payment continues until the transfer at the request of a person retired for other reasons or at his request is renewed at a rate that was set to the translation. To such transfer, the pensions established prior to the entry into force of the Law of Ukraine “On amendments to some legislative acts of Ukraine regarding the improvement of pensions” is not visible and the pension is not indexed.
From 1 October 2017 pension, appointed after the entry into force of the Law of Ukraine “About measures for legislative ensuring reforming of pension system” (except for persons with disabilities of I and II groups, persons with disabilities as a result of war III groups and combatants, the persons referred to in paragraph 1 of article 10 of the law of Ukraine “On status of war veterans, guarantees of their social protection”) in accordance with the Law of Ukraine “On state service” in the period of work at positions of civil service prescribed by Law 889, as well as working positions and conditions, stipulated by the law of Ukraine “On Prosecutor’s office”, “On judicial system and status of judges” shall be paid in the amount calculated according to the Law of Ukraine “On compulsory state pension insurance”.
After the dismissal, payment of a pension in accordance with these Laws is resumed.
Payment to working pensioners in the period of work on the other posts of pensions, appointed on the terms of the law of Ukraine “On civil service” from 1 October 2017 resumes in the prescribed amounts.
The maximum size of pensions, assigned in accordance with the Law of Ukraine “On civil service” (including bonuses, raises, additional pensions, the target monetary assistance, pensions for special merits to Ukraine, indexation and other surcharges to the pensions established by the legislation, except for extra allowances to separate categories of persons having special merits before the Homeland) cannot exceed ten subsistence minimum established for persons incapacitated. Temporarily, until 31 December 2017, the maximum pension (including bonuses, raises, additional pensions, the target monetary assistance, pensions for special merits to Ukraine, indexation and other surcharges to the pensions established by the legislation, except for extra allowances to certain categories of persons who have special merits before the Homeland) may not exceed 10 740 hryvnias.
