Russia will be able to suspend legal entities for the repeated violation of fire regulations
Amendments are proposed to the Code of administrative offences
MOSCOW, January 30. /TASS/. The government on Thursday submitted to the state Duma a draft law allowing to suspend the work of legal entities in case of repeated violations of fire safety rules similar to those that were allowed in the Mall “Winter cherry”. The amendments are proposed to the Code of administrative offences (Cao). According to the document, repeated violation of requirements of fire safety at the facility, classified as extremely high, high or substantial risk, namely the failure or malfunction of the sources of fire water supply, electrical installations, electrical automatic or Autonomous fire-fighting installations, fire alarm systems, warning and evacuation management of people during fire, smoke protection or discrepancy evacuation routes and emergency exits the requirements entails a fine for citizens in the amount from 3 thousand to 4 thousand rubles, for officials – from 15 thousand to 20 thousand rubles for individual entrepreneurs – from 30 thousand to 40 thousand rubles or administrative suspension of activity for up to 30 days, and for legal entities – from 200 thousand to 400 thousand rubles or suspension of operation for up to 30 days.”
“Currently, there is no statutory administrative responsibility in the form of administrative suspension of activities for violation of fire safety regulations except for violations that resulted in fire and caused serious harm to human health or human death,” say the developers in the explanatory material.
The Cabinet noted that the administrative code allows to suspend the activities of the organization “for repeat failure in the period the legal provisions on exercising the state fire supervision”. However, “for violation of fire safety requirements at the facility like Mall, “Winter cherry”, carries a potential threat to life and health of a large number of people, this type of administrative punishment is not provided.” According to the explanatory materials data, in the framework of audits conducted in 2018 on objects with mass stay of people, in claims of Prosecutor’s office of the court sent the materials on the suspension of the 618 objects, activities of which 435 (70%) was suspended, “that is, the violations identified during inspections, was recognized by the court threaten the life or health of citizens”.
