Over the debtors in Russia decided to take pity

The Ministry of economic development (MED) of the Russian Federation opposed the “overly rigid approach to debt collection” for fear of the development of the informal sector in this market, and offered for the recovery of debts from the citizens to leave them not less than the subsistence minimum.

The bill has already received positive feedback from the Ministry of justice, Ministry of Finance, the Federal service of bailiffs and the Ministry of labour, submitted to the government, reports “Interfax”.

In addition, in particular, amendments to the law “On enforcement proceedings” of the offer to forbid to collect debts from insurance old-age pensions and disability and fixed payments to these pensions.

However, all these developments will not affect debtors alimony, utilities, fines and taxes those who must pay the damages from a crime.

We will remind, last week it became known that in Russia can be a mandatory pre-trial procedure of debt collection from natural persons. The bill developed by the Ministry of justice and the Federal service of court bailiffs (FSSP). The document also proposes to require to include in the special register of the FSSP not only collectors, but also the credit institution. The initial cost of the implementation of the law, the developers estimate in the amount of 5.2 million rubles. To bring the bill to the government is planned before the end of this year.

As pointed out by the newspaper “Kommersant”, the document drafted in the framework of the “regulatory guillotine” to replace the law on recovery of debts of physical persons. Currently, the creditor may apply to the court for any day of delay. The Ministry proposes to establish a mandatory pre-trial (claim) procedure prior to filing a claim is 30 days. This means that the lender can go to court only if, after receipt of the claim by the debtor within the prescribed period will not pay the debt. The authors of the bill believe that the amendments will reduce the burden on the courts and bailiffs.

We also add that the vast majority of Russians (76%) prefer not to use borrowed capital, believing that to take the credit is necessary only in case of urgent need. These are published last week the results of a survey of Fund “Public opinion” (FOM).

However, a third of respondents (33%) admitted that now have either banking or consumer credit, issued on his own name, and 67% of respondents reported that it is currently not encumbered by any loans.

Moreover, according to the survey, 88% of Russians do not intend to in the next year to take out new loans, although 14% of respondents loans is a common practice.
