NACP exposed two MPs on lobbying for their own interests

MPs can expect a fine up to 500 tax-free minimum incomes of citizens.

The national Agency for prevention of corruption exposed MPs Svyatash Dmitry and Yaroslav dubnevich, who had a conflict of interest when exercising their powers.

About it reported in a press-service of the NACP.

On the revealed facts, the Protocol on adminnarushenii under part 2 of article 172-7 of the Cao (violation of the requirements for the prevention and settlement of conflict of interests), they are sent to court.

The sanction of article prescribes punishment in the form of a penalty from 100 to 200 non-taxable minimum incomes of citizens, and when performing acts or making decisions in a real conflict of interests – a fine of 200 to 400 tax-free minimum incomes of citizens.

Information about the violation of people’s deputies were received from journalists, NGOs and activists.

In particular it was a question of personal interest in signing the deputies of the constitutional petition of July 10, 2018 unconstitutionality of certain provisions of the code of criminal procedure and the law which defines the powers of the Agency for search and management of assets (ARMA).

“NACP gathered evidence confirming that the deputies had a personal interest in the consideration of the court of such representation. It is established that law enforcement agencies carry out pre-trial investigation of criminal proceedings on the fact of appropriation of loan funds of JSC UkrSibbank, manufacture and use of false documents. As part of the investigation was the arrest and transferred to the control of ARMA real estate and corporate rights of a number of enterprises, in particular, OOO, OOO Legallais and Ukrbiznes LTD, whose founder is two legal entities: OOO FAV-the country and the company Paymark Resources Corp., Panama” – reported in the NACP.

The ultimate beneficiary, OOO FAV-Ukraine is the mother of Dmitry Svyatash.

It is also established that the Deputy had received power of attorney to represent the company, Paymark Resources Corp., parent company of Legallais and Ukrbiznes LTD.

“Oh Dubnevich it was found that the pre-trial investigation of criminal proceedings on the fact of taking possession of more than 300 million cubic meters of natural gas of Naftogaz of Ukraine was arrested and transferred to the control of ARMA integral property complexes Novorosiyskoe Novoyavorovskoe CHP and CHP plants owned by Energiya, OOO-Nevyezde and NPP Energiya-Novoyavorivsk, the ultimate beneficial owner (controller) which directly has a Deputy”, – stated in the message.

Therefore, NACP found that Svyatash and Dubnevich committed acts and made a decision in a real conflict of interest: taking advantage of their parliamentary powers concerning the right to constitutional petition, along with other people’s deputies of Ukraine applied to the constitutional Court with a constitutional submission, in respect of which a private interest.
