Judge of the constitutional court of the Russian Federation Konstantin aranovsky called the Soviet Union “an illegal government”, the authorities which are responsible for many crimes. He also said that the Russian Federation should not be considered the successor of the “repressive and terrorist acts” of the USSR, writes “Kommersant”.

In a dissenting opinion in one of the decisions of the COP aranovsky noted that Russia should have the constitutional status of the state, “nothing to do with totalitarian crimes” because “it has been recreated against the totalitarian regime instead of him.” This opinion the judge took the case on reimbursement of housing, taken away in the purges during the Soviet era.

Aranovsky is sure that Russia should compensate the damage caused to the Soviet Union — but not as a successor state responsible, and “with faith in the truth of the positive responsibility and mercy.” Thus, according to him, the rehabilitation of victims of repression should not be considered as reparation by the culprit. He calls the controversial “the succession on transferring to Russia’s commitments to the Communist Soviet regime of its repressive and terrorist acts.”

Aranovsky said that Russia should not replace the “fallen state socialism” as the Soviet government carries “immense guilt” for various unforgivable crimes “beginning with the overthrow of the legitimate government of the Constituent Assembly”. “With such a fault state is not entitled to, and is unable lawfully to exist, insulting the justice, freedom and humanity,” he says.

Aranovsky stipulates that said to them “does not negate the important aspects of the <…> in recognition of membership in international institutions, and because of the retention areas, objects and complexes, jurisdictions, Russia inherited from the former public entity.”
