The deputies voted for the law on establishing the Higher anti-corruption court.
Thursday, June 21, the Verkhovna Rada from the second attempt voted for a basis and in entirety for the launch of the anti-corruption court (No. 7441), who earlier in the Parliament were introduced by the President of Ukraine Petro Poroshenko.
For a decision voted 265 deputies.
The law is expected to create Higher anti-corruption court on location in Kiev and to authorize the Cabinet to provide financing of activities related to its formation and activities. The costs associated with the implementation of the provisions of the law will be implemented at the expense of funds envisaged in the state budget of Ukraine for the year 2018.
In the section “Final provisions” specifies that this act shall enter into force on the day following its publication. The Cabinet is entrusted to carry out within the competence measures, with Higher anti-corruption court, the State judicial administration to adopt the measures necessary for the implementation of the document.
The highest anti-corruption court will consider a case against top corrupt officials, who accused the NEB. In particular, according to the offences regarding the misuse of budget funds, abuse of authority or influence, illicit enrichment, bribery.
To the judges of the Anticorruption court is the Highest qualification Commission of judges with the help of the Public Council of international experts. The composition of the Public Council of international experts will be able to enter both foreigners and Ukrainians, “which have an impeccable reputation, high professional and moral qualities” and the experience of 5 years for implementation of the procedural management, support of state prosecution in court or the proceedings in cases of corruption abroad.
For candidates for the post of judge anti-corruption court promulgated the following requirements: the candidate must have experience as a judge 5 years, or for the posts of lawyer of 7 years, or research activities in the field of law from 7 years. Also, the judge anti-corruption court will have to comply with the requirements in accordance with the law “On judicial system and status of judges”; to have knowledge and skills in order that proceedings in corruption cases.
