The maximum penalty is eight years imprisonment.
The Verkhovna Rada on Thursday, October 18, voted for the introduction of criminal liability for illegal border crossing.
The adoption of the bill No. 7017 in the second reading and generally supported by 243 deputies at minimum necessary 226.
In comparison with the first reading the bill has undergone significant changes. If amended, voted on 6 September, the criminal liability threatens all of the citizens of Russia who have committed illegal border crossing, now this list is limited.
Article 332-2 of the Criminal code “Illegal crossing of the state border of Ukraine” provides the following:
“The crossing of the state border of Ukraine with the purpose of causing harm to the interests of the state or a person who denied entry to the territory of Ukraine, and representatives of the armed forces or other law enforcement agencies of the state-aggressor [Russia] in any way outside the checkpoints across the state border of Ukraine or at checkpoints across the state border of Ukraine without proper documents or documents containing inaccurate information, shall be punishable by deprivation of liberty for a term up to three years.”
The same offence committed repeatedly or by a group of persons, shall be punished by imprisonment from three to five years.
The same violation committed with use of force or use of weapons, shall be punished by imprisonment from five to eight years.
The law will come into force from the day following publication.
At the moment, for illegal crossing of the state border is provided only administrative responsibility.
