Putin knew that such an action is planned, but did not take measures to prevent it, said the diplomat.
Russian President Vladimir Putin may be prosecuted if it is proved that he knew about the preparation of the crime – the attack on the passenger plane Boeing-777, and did not take measures to prevent this, or if knowing the names of the persons who committed the crime, but did not give them justice.
This was told by Ambassador extraordinary and Plenipotentiary of Ukraine, ex-representative of Ukraine to the UN Council on human rights Vladimir Vasilenko.
Responding to a question about whether the investigation of the Donbass shot down a passenger plane to reach the first persons of Russia, the diplomat said, “Maybe if there’s sufficient evidence. At least, if it is proved that the first person of Russia – President Vladimir Putin knew that such an action is planned, but did not take measures to prevent it, he is already responsible. If it is proved that he reported on individuals who committed this crime, and he did not punish them and refuses to give the result, then it also bears responsibility.”
“The boundaries of this liability determined by the court”, – said Vasilenko.
In respect of the court, which will be held in the Netherlands, he said: “I do not think that the court will continue forever, because it is a national court. However, I do not know whether the laws of the Netherlands in absentia conviction of criminals. First of all, individuals suspected of committing a crime, will be focused agenda. But these individuals may refuse to be present at the hearing. In this case, problems may arise of a procedural order. If the criminal law of the Netherlands provides for in absentia conviction, then there is a trial, been sentenced and the case of the detention of these criminals.”
The diplomat also did not rule out that in the Netherlands could be a special law which will allow to cope with such difficulties.
As pointed out by Vasilenko, “the international Commission of inquiry had already collected a lot of material, there are listed the names of specific perpetrators of the crime”. Now the task of the court is to “ascertain whether they have acted on their own or carried out a criminal order. If they were following orders, at what level it was given. Should be investigated the effects of the vertical of power in the army structures of Russia. Was the order given from the top – commander-in-chief of the Russian armed forces, or this order was given by chief of the General staff, the chief of the military unit, which operated at discretion”, – he said.
