The city Council could not cancel its ban on night sale of alcohol.
The decision of Economic court of Kiev, which obliges the Council to lift the ban on the sale of alcohol, low alcohol beverages and beer in stationary objects of trade from 23.00 to 10.00, cannot be performed.
About it the Deputy of the Kiev city Council, the initiator of the ban Vladislav Mikhailenko said at a briefing.
“Neither the court decision nor the decision of the Antimonopoly Committee cannot reverse the decision of the collegial body – the city Council,” he said.
Mikhailenko noted that the decision to ban night trading of alcohol was a kind of contract between the sellers and the city, which did not provide for any sanctions for non-compliance.
The decision can be reversed only by a new vote of the city Council, the Deputy emphasized.
He added that the commercial court has not specified how it should be implemented that decision.
September 22, 2016, the deputies of Kyiv city Council imposed a ban on the sale of alcohol in the capital at night. The decision came into force on 12 October.
April 10, the Economic court of Kyiv has ordered the Kyiv city Council to lift the ban on the sale of alcohol at night, having satisfied the claim of the Antimonopoly Committee.
