The court in the Hague: Ukraine cited arguments in favor of measures against Russia

Wednesday, March 8, the International court of justice in the Hague, the arguments in favor of measures against stated the representative of the Ukrainian side, Dr. Harold Koch.

He accused representatives of the Russian Federation in the “misrepresentation of laws and facts”, “legal acrobatics” and assured the Court that provisional measures should enter immediately.

“In a nutshell, the Court is facing a tragic situation which requires urgent regulation. The facts as presented by Ukraine show that the situation needs to be addressed urgently – in the East of Ukraine and in the Crimea.”

“As in previous lawsuit filed against Russia by Georgia, the Court shall appoint the provisional measures because firstly, the conditions are unstable and can change quickly, and secondly, there is a vulnerable population that needs your protection is the innocent civilian population of Ukraine. Third, because there is a tension because of the continuation of the conflict. And, fourth, continuing the attack and resulting deaths, injuries and displacement of the local population,” said Koch.

The representative of the Ukrainian side said that the Russian side noted that “there is no need of introduction urgent measures”.

“Why? Because MH17 was already destroyed, and the attack on the civilian population, which spoke Ukrainian side was made a month ago?”, – said Koch.

According to him, if the Russian authorities did not give the order to patrol its borders with Ukraine, even “more dangerous weapons might once again come to Eastern Ukraine tomorrow, and the terrible attack on civilians in Avdiivka was only a week ago.”

“Let me emphasize that Ukraine did not plan to this Court to bring all the facts of violations of international law by Russia or the confirmation of the Crimea. Your task is to decide whether Ukraine can now afford temporary protection at the time when the Court will continue to consider the claim. Legislative acrobatics that we heard from the Russian representative, is that the international rules that apply to other States are not applicable in Russia. All requests Ukraine, this Court is to use its powers to protect the innocent Ukrainian citizens that are threatened by discriminatory and terrorist attacks, and cultural extinction. Without the provisional measures, established by this Court of the Russian Federation will continue to play by their own rules and do the opposite of the requirements of the Conventions (for the suppression of the financing of terrorism and on the elimination of all forms of racial discrimination – ed.), paying for it is innocent civilians,” – said the representative of Ukraine.

He stated that Ukraine is now asking the Court to force Russia to stop supplying weapons and assistance across the border to groups that commit terrorist attacks against civilians (in the Donbas), and to stop the cultural destruction of the Ukrainians and Crimean Tatars in Crimea.

“If Russia is not involved in these criminal actions, then she will not suffer from any limitations at the time when the matter will be considered,” said Koch.

Recall, March 6 in the Hague (Netherlands) began hearings on the suit of Ukraine against Russia about the responsibility for committing acts of terrorism and discrimination.

The lawsuit was filed on January 16, 2017 in the international Court of justice with the aim to attract the Russian Federation responsible for support of terrorism in Eastern Ukraine, and discrimination against ethnic Ukrainians and Crimean Tatars in the occupied Crimea.

Meeting on the preventive measures will last for 4 days – from 6 to 9 March. On 6 March its position was represented by the Ukraine, 7 will represent Russia, on 8 and 9 March Ukraine and Russia will provide comments on each other’s positions.

Ukraine is represented by Deputy foreign Minister for European integration issues Elena zerkal, as well as American Professor Harold Honju CoE and marney cheek, a partner at law firm Covington, which has a contract with Ukraine on representation of interests of Kiev in the international courts.
