The Verkhovna Rada adopted the law on combating undue pressure law enforcement agencies to Ukrainian enterprises.
“For” government bill No. 7275 voted 312 deputies.
As reported on the website of the Cabinet, the document was developed jointly by the Ministry of justice, Ministry of internal Affairs, Cabinet Secretariat, Office of the business Ombudsman, and other agencies. The key innovations of the document – the prohibition and the invalidity of evidence obtained in the execution of the search warrant, issued without technical fixing. The same will be invalid evidence obtained during a search that was not allowed counsel.
In addition, the document introduces mandatory audio and video recording of the search. And evidence obtained during the search and is not fixed by technical means, shall be declared inadmissible and invalid. It prohibits the seizure of original financial and accounting records, computer equipment, servers and mobile phones businesses. Also prohibited re-energizing the closed criminal proceedings. At the same time, the bill provides a reasonable time of criminal proceedings. In particular, individuals whose rights are limited, have the right to appeal the inaction of the investigator and make the application for reasonable production time.
However, business representatives have the right to confirm the registration of criminal proceedings. Introduces a mechanism to audit the activities of law enforcement agencies towards the investigation of economic crime, increase the responsibility of law enforcement officers for misconduct.
