Correspondence investigation against Yanukovych must be stopped, said the lawyer of ex-President Vitaly Serdyuk. Also the lawyer said that the GPU doesn’t agree. He said this in comments to the Ukrainian truth.
“After receiving the Prosecutor General of Ukraine the Prosecutor General of the Russian Federation official confirmation of the address of residence of Viktor Yanukovych and the agreement on assistance in performing all necessary procedural actions, in the GPU there is no reason to apply in respect of Viktor Yanukovych, the procedure for special (private) pre-trial investigation”, – he said.
He insists that the correspondence investigation Yanukovych has been terminated in accordance with part 5 of article 297-4 Criminal procedural code of Ukraine, according to which, if the reasons for the correspondence of pre-trial investigation “ceased to exist”, further pre-trial investigation is carried out in a General manner.
“Any attempt to further conduct in absentia proceedings is a criminal offence and a violation of the right to defence guaranteed in both Ukrainian and international legislation”, – said Vitaly Serdyuk.
“In case of ignoring by the staff of the GPU of this fact, the protection will be forced to give a statement about the crime,” – said the lawyer.
He also called the address of residence of Yanukovych.
“This address is known for a long time, it was official correspondence. This is not a warehouse, this residential house is built separately in the cottage small town. There is a fenced residential house”, – said Serdyuk.
On the question of whether Yanukovych is living there permanently, or this url is used only for correspondence, Serdyuk said
“He resides at this address, but my customer travels a lot on business trips. Given the fact that wanted it not, he is free to travel in Russia and around the world. He was not wanted, so there are no restrictions”, – said Serdyuk.
He did not answer the question of what exactly the nature of these trips Yanukovych, and where exactly he travels.
“We met in different places”, – said Serdyuk.
At the same time, the Prosecutor’s office noted that the only reason for the termination of the correspondence investigation is the voluntary emergence of Yanukovych in Ukraine.
In comments to the Ukrainian truth, the Prosecutor of the military Prosecutor Roman Kravchenko said:
“Absentee, the investigation would end, only if he will voluntarily return to Ukraine. The address that called the lawyers of Yanukovych, we not confirmed.”
