The law “On Amnesty in 2016” came into force.
Today in Ukraine came into force the law on Amnesty. The document provides Amnesty to persons previously convicted for intentional less serious and not serious crimes. And also convicted of careless sovershenii crimes that are not serious.
The Amnesty can apply, in particular, to the following categories of convicts:
– persons who at the time of the violation was a minor;
– pregnant women of today women;
– parents of minor children or disabled children (if these convicts are not deprived of parental rights);
– persons recognized as disabled;
– prisoners who at the moment have reached retirement age;
– veterans;
– participants of liquidation of Chernobyl accident;
– children of parents older than 70 or parents-invalids, if they had no other able-bodied children.
The law also directed the participants of the ATO. The Amnesty allowed in respect of the “combatants, persons who defended the independence, sovereignty and territorial integrity of Ukraine directly involved in ATO”. It is only those participants ATO who have not committed serious crimes.
Note, if the convicted person is serving a sentence for non-violent and not particularly serious crime, it may be exempt from punishment if he served less than half the term of the main sentence.
Persons convicted not of a particularly serious crime, can reduce by half the unserved part of the punishment, if these persons do not fall under the above-described categories.
The decision to use or not to use the Amnesty takes the court against each person individually. This comes after a thorough verification of personal records and information on the behaviour of the convict during the punishment, – this is stated in the text of the law.
The President of Ukraine Petro Poroshenko has signed the law “On Amnesty in 2016,” September 2, at the request of Church leaders and Heroes of Ukraine. The law is enforceable within three months.
