The offender has died in a penal colony.
In penal colony №5 in Vologda region, known as “the Vologda coin”, died Lom-Ali gaitukayev, convicted of involvement in the murder of journalist Anna Politkovskaya.
According to the lawyer Gaitukayev, Helena Kharionovsky, shortly after the court decision, 3 November 2015, he was placed in a medical institution in connection with sharp deterioration of state of health.
“Doctors have recognized his disability, he among other things was diagnosed with cirrhosis of the liver. He was allowed extra food. Those products that were made by doctors, I bought and brought Gaitukaev – money sent to relatives,” she said.
Kharionovsky also said that the hospital came the Moscow doctors who confirmed the diagnosis made by the Vologda doctors.
“They also said that the Outlook is poor, the medicine here is powerless,” said the lawyer.
She noted that according to article 81 of the criminal code disease Gaitukayev was included in the list of diseases which can be grounds for exemption from punishment.
“We have prepared a petition for his release, referring to article 81 of the criminal code. And on Saturday (10 June) he died”, – said the lawyer. According to her, today, June 13 the body Gaitukayev will be given to relatives to transport him to Chechnya, where he will be buried in the family cemetery.
According to the nephew of a convicted Temirlan Gaitukayev, his cousin had been in the colony beatings. He explained that came out in “the Vologda coin” and saw bruises all over the body.
“But uncle then said that the bruises – it’s okay, will. But he was severely beaten by the liver and kidneys,” said he.
Upon beating Gaitukayev in 2015 the defense has tried to bring a case.
“But we were refused, the court reasoned that the fact of use of physical force is not proven, and therefore there is no crime,” – said Kharionovsky.
As said the lawyer Tatiana Okushko, who prepared the complaint Lom-Ali Gaitukayev to the European court on violations in the judicial process, the receivers in the European court the next of kin.
We will remind, the journalist, human rights activist, a fighter against the Putin government and the propaganda Anna Politkovskaya was shot dead in the Elevator of her apartment block in Central Moscow on 7 October 2006.
At the end of may 2014, the court found guilty of the murder of journalist native of Chechnya Lom-Ali Gaitukayev, his nephews Rustam, Jabrail and Mahmudovich and former operative of the Moscow police Sergei hadzhikurbanova. The assassination was never established.
