It is established that the notary made a deal with the use of forged and unverified documents.
The Ministry of justice of Ukraine has cancelled the decision on re-registration of ownership rights to the 52 apartments in not introduced into operation an apartment house on street the Kharkov highway 15-A, in the Dneprovsky district of Kiev.
The investigation allowed us to determine that the actions of the notary who carried out the re-registration could be done on the basis of forged and unverified documents.
The decision adopted by the Commission for the review of complaints in the sphere of state registration at the Ministry of justice.
As noted by Committee member Elizabeth Makogon, 30 December 2016, the Ministry received a complaint from the “Classic construction” acting as customer of construction of a residential building in Kharkov highway 15-A, in Kiev, on illegal actions of the private notary, the state Registrar Oksana Buryak.
According to Makogon, solutions of a notary in the State register of proprietary rights to real estate entries have been made, in accordance with which the ownership rights for apartments in the residential building was reclassified to a subsidiary (DP) “TBS” (Kiev).
The notary could be made on the basis of forged documents provided by third parties. In addition, the notary had no legal grounds for re-registration of rights of ownership of the asset, which is not commissioned.
“The notary has violated the norms of the current legislation, because at the time of registration of the real estate it needs to verify that you entered the house in operation. Accordingly, he was obliged to ask for documents from archival registers, to verify their authenticity and then carry out registration activity that has not been done”, – said the head of the legal Department of the law firm “Uvito”, Peter Sergeyev.
The Commission unanimously adopted the decision to satisfy the complaint of LLC “Classic construction” in full.
In addition, the Commission permanently revoked Oksana Buryak access to the state registry, and will require the cancellation of its resolution on notarial activity.
