GPU reported Yanukovych on suspicion of a constitutional coup

The accused in the case also became Oleksandr Lavrynovych.

Prosecutors said the ex-President Viktor Yanukovych and ex-Minister of justice Oleksandr Lavrynovych on suspicion in capture of the government. It comes to amending the Constitution in 2010.

“The Department of special investigation GPU investigated the case of the constitutional revolution of 2010, which led to the seizure of state power by expanding the unconstitutional way the powers of the President of Ukraine at the expense of the shrinking role and powers of Parliament and Government. Based on the collected evidence it is reported about suspicion under part 1 of article 109 of the criminal code of Ukraine ex-President Yanukovych and ex-Minister of justice Alexander Lavrinovich committing together with other persons of the seizure of state power, including through the adoption of measures on illegal, without addressing a single body of legislative power in Ukraine – the Verkhovna Rada of Ukraine to change the Constitution of Ukraine by means of entry in the Unified state register of legal acts of the text of the Constitution of Ukraine of 1996 and its official publication,” he wrote on Facebook the Prosecutor General Yury Lutsenko.

Recall, the case against Yanukovych to seize power in an unconstitutional way by changing the Constitution in 2010, the Prosecutor General’s office started investigating in March 2014. Among the defendants were the judges of the constitutional court pass the decision, but in may of this year it became known that the GPU had failed to collect evidence for prosecution.

On 8 December 2004 the Verkhovna Rada adopted the law “On amendments to the Constitution of Ukraine”, which provided for the transition from presidential-parliamentary to a parliamentary-presidential form of government. In the autumn of 2010 the constitutional Court declared the law illegitimate, and returned the Constitution of 1996.

After the overthrow of Yanukovych, Parliament has renewed the Constitution in edition of 2004.

Yanukovych also charged that on March 1, 2014, staying on the territory of the Russian Federation, he committed treason by submitting a written statement to the President of the Russian Federation with a request to use Russian troops on the territory of Ukraine. This subsequently led to the loss of the Crimea and Ukraine of objects of state property amounting to more than 1,080 trillion hryvnia. The case is now being heard in court.

In other cases against Yanukovych, which relate to the murders on the Maidan and theft of public funds charges against the former President are not yet filed.
