Gazprom has lost a court in Ukraine on 172 billion

The Supreme economic court dismissed the appeal of the Gazprom company (Russia) on the decision on collecting of fines and penalties imposed by the Antimonopoly Committee, the total amount of 172 billion hryvnia (about $6.5 billion) for abuse of a monopoly position in the market of natural gas transit through Ukraine.

The decision was announced by presiding judge Valentyn Paliy, the correspondent of the Ukrainian news from the courtroom.

“The court ruled: the decision of economic court from December 5, 2016 and the decision of the Kiev court of appeal dated 22 February 2017 at the suit of AMC to remain unchanged, the cassation Gazprom to refuse,” announced paly.

Recall that in January 2016 the AMCU has fined Gazprom 85 billion UAH for abuse of monopoly position on the market of transit of natural gas Ukraine. Then this decision was confirmed several times by the Ukrainian courts.

12 APR 2016 Gazprom filed a lawsuit in Kyiv Economic court to recognize invalid the decision of the AMC, but the claim was not accepted by the court for consideration.

Kyiv economic court of appeal once again on February 22 upheld the decision of the lower court confirming the penalty Gazprom penalty, which has grown to well over 172 billion UAH (about $6.5 billion) due to the penalties for its non-payment.

AMC filed a lawsuit in the Economic court of Kiev on the forced recovery of fine and penalty (similar penalty) 5 Oct 2016.

The Ministry of energy of Russia 9 December 2016 expressed concern about the decision of the Economic court of Kyiv to recover from the Gazprom penalty, and stated that penalties cause risks to the reliability and stability of Russian gas transit through Ukraine.

The energy Ministry of Russia urged Ukraine to cancel the decision.

The Minister of energy and coal industry Igor Nasalik believes that the withdrawal of the transit gas under the possible implementation of the decision of the Economic court of Kyiv to recover from Gazprom the fine impossible.

Also Nasalik confirmed that Prime Minister Vladimir Groisman guaranteed by the European Commission, that the transit of gas will not be arrested by the court.

The decision on the obligation to pay the fine and penalty was entered on February 22.
