Firtash won a court HMO

The court of appeal confirmed the decision of the Stockholm arbitration about the duty of the SCR before Ostchem Dmitry Firtash.

The court of appeals on may 10 upheld the decision of the Yuzhnensky city court on the petition of the company Ostchem Dmitry Firtash about the possibility to implement in Ukraine the decision of the Stockholm arbitration on collecting from the Odessa portside plant (OPP) $193 million of debt, not counting interest and penalties.

This was announced acting head of the state property Fund (SPF) of Ukraine Dmytro Parfenenko.

“Yesterday, the court of appeal rejected all our appeals and petitions… Opened a potential path to bankruptcy IPF,” he said at the Cabinet meeting on Thursday.

Prime Minister Vladimir Groisman said that it is the duty of almost $300 million.

According to Parfenenko, state property Fund and the plant are preparing an appeal and a petition to stop this decision, as well as a series of technological steps that would have prevented the bankruptcy of the SCR.

“All this creates the impression of some kind of deliberate campaign to destroy the investment attractiveness of the enterprise. In conclusion, I can only say one thing: all this requires a quick privatization and finding an effective owner for the SCR”, – summarized the acting head of the SPF.

In turn, the Prime Minister asked whether it was true that the HMO’s lawyers arrived at the court of Appeals.

“The absolute truth. We changed lawyers, or rather not we, but the SCR … This company is a “daughter” Vasil Kisil and Partners. The lawyers filed several motions on appeal, but yesterday (may 10 – ed.) the court did not appear. Today at the 12 hours of the relevant Deputy head, state property Fund, holds a meeting with participation of leadership of HMO’s and the lawyers … Will conduct “debriefing”, but it depressing,” said Parfenenko.

The Prime Minister called this situation “a conspiracy”.

“I believe that now is the conspiracy, which began last year, when the government is completely in good faith has approved the public sale. In August (2016 – ed.) was a conspiracy to lose one court, and now to lose the other courts … All this contributes to start the bankruptcy of the enterprise owned by the people. The Director of the factory, hired the lawyers, I’m sure, involved in this dirty scheme,” concluded the head of government.
